Terms of Service

Effective Date: 4/30/25

The following terms of service (the "Terms") constitute a legally binding agreement between you (also referred to below as "Customer") and Moovers, LLC. ("Moovers"). These Terms govern your access to and/or use of (i) Moover's website, including without limitation its website at www.usemoovers.com, (ii) Moover's telephone ordering platform (the "Telephone Platform") (collectively, the Website and the Telephone Platform are referred to herein as the "Moovers Platforms"). These Terms also govern any services that you may receive through the Moovers Platforms, including, but not limited to, any services that you may receive from Moovers, its subsidiaries, or affiliates, or the Third Party Providers.

1. ACCEPTANCE OF TERMS

By booking services through our website, phone, or email, Customer agrees to these legally binding Terms. Services are confirmed upon booking receipt.

2. DEFINITIONS

  • "Quoted Job": Fixed-price move confirmed in writing.
  • "Hourly Job": Services billed at hourly rate + materials.
  • "Booking Confirmation": When Customer receives written confirmation of reserved move date/time.

3. LIABILITY WAIVER: PERSONAL INJURY

3.1 Customer and all persons at move location assume injury risks during packing/loading/transport/unloading.

3.2 Customer waives right to sue for injuries/death unless caused by gross negligence or willful misconduct by our crew.

3.3 Customer must disclose hazards (e.g., broken stairs, aggressive pets) before move start.

4. PROPERTY DAMAGE & LOSS

4.1 Released Value Protection (Standard):
Maximum liability = $0.60 per pound per item (e.g., 100 lb item = $60 compensation).

4.2 Exclusions (No Liability):

  • Items packed by Customer
  • Fragile items (glass, electronics, art) unless packed by us
  • Perishables, jewelry, cash, documents, or pets
  • Damage from hidden defects or pre-existing damage
  • Items not disclosed

5. DELAYS, SERVICE INTERRUPTIONS & COMPANY CANCELLATIONS

5.1 Not liable for delays/cancellations caused by:

  • Weather, traffic, accidents, mechanical failures
  • Crew shortages or contractor no-shows
  • Acts of God (floods, fires), strikes, or government orders
  • Facility access issues or safety concerns

5.2 Company-Initiated Cancellations:

We reserve the right to cancel with less than 24 hours notice for:

  • Equipment failure
  • Crew unavailability
  • Safety/weather emergencies
  • Customer misrepresentation

Our sole liability: Refund of deposit/payments made

No compensation for:

  • "Wasted time," emotional distress, or inconvenience
  • Consequential damages (hotels, storage fees, lost wages)

6. CUSTOMER RESPONSIBILITIES

6.1 Disclose all items (especially high-value items >$100/lb).

6.2 Secure pets, disconnect appliances, ensure safe access.

6.3 Be present to confirm inventory at pickup/delivery.

7. PAYMENT, CANCELLATION & CHANGES

7.1 Cancellation Fees (Effective Immediately After Booking Confirmation):

  • Quoted Jobs: 20% of total quoted price
  • Hourly Jobs: $150 flat fee
  • Deposits are non-refundable once booking is confirmed

7.2 Rescheduling:

  • Free of charge
  • Subject to next available slot (availability not guaranteed)

7.3 Changes to Scope:

  • No fees for service modifications
  • Last-minute changes may not be accommodated

8. SERVICE MODIFICATIONS & AVAILABILITY

8.1 Schedule is not guaranteed for rescheduled moves or last-minute changes.

8.2 We reserve the right to substitute contractors or equipment without notice.

9. CLAIMS PROCESS

9.1 Report damage in writing within 30 days of delivery.

9.2 Provide:

  • Photos of damage
  • Proof of value (receipts)
  • Signed inventory sheet

9.3 Claims resolved only under Released Value Protection ($0.60/lb per item).

10. LIMITATION OF LIABILITY

10.1 Total liability for any claim will not exceed fees paid for the move.

10.2 Excluded liabilities:

  • Emotional distress, inconvenience, punitive damages
  • Losses from delays (Section 5) or excluded items (Section 4.2)

11. DISPUTE RESOLUTION & GOVERNING LAW

11.1 Disputes resolved via binding arbitration in [County], Texas.

11.2 Customer waives right to class-action lawsuits or jury trials.

11.3 These Terms are governed by Texas law.

ACKNOWLEDGEMENT

"I understand that:
(1) Cancellation AFTER booking confirmation incurs fees (20% for quoted jobs/$150 for hourly jobs).
(2) Moovers may cancel with <24 hours notice for emergencies with only deposit refund.
(3) Liability for property damage is limited to $0.60 per pound per item.
(4) No compensation for delays, cancellations, or consequential losses."
